Is Bankruptcy Right for you?
Let’s start with a quick overview:
What is bankruptcy?
Bankruptcy is a legal process whereby an individual or business attempts to either eliminate or reorganize debt so they can move forward with a “fresh start.” Through this process, our bankruptcy lawyers may be able to help you stop foreclosures and repossessions, stop harassing creditor phone calls, stop creditor lawsuits and eliminate debt (sometimes including IRS debt and 2nd mortgages).
There are several bankruptcy options available; however, Chapters 7 and 13 are the most common (chapter 11’s are expensive, time consuming, and reserved for businesses). Which of these bankruptcy chapters is best for you depends upon many different factors,
such as:
  • Are you filing as an individual or a business?
  • Is your goal to eliminate debt or to reorganize your debt?
  • Do you have the ability to pay back your creditors.
We may be able help you decide the answers to these critical questions through
a Free 15 minute consultation. Call now.

Do I need a bankruptcy attorney? No, just like you don’t need your own dentist or your own car mechanic. Although you don’t have to have an attorney to file bankruptcy, the federal Bankruptcy Code is intricate and contains many nuances that a novice could find overwhelming, complicated, and emotionally draining.

Do not be afraid of the cost retaining a good attorney. Our fees are very reasonable. After your free initial consult they are:
  • Typically $2,000 for a Chapter 7 (plus costs)
  • Typically $4,500 for Chapter 13 (plus costs) *
*These fees are typical but could be somewhat higher or lower depending on the complexity of your case (such as the presence of tax debts; the desire to strip off a second mortgage; having multiple parcels of real property in foreclosure or default; etc.).
